🇺🇸 TERMS AND CONDITIONS OF SALE AND LIABILITY (AEGON IRON WORK)
This Limited Warranty and Disclaimer of Liability contains important provisions that limit the liability of Aegon Iron Work.
These Terms and Conditions, together with our Shipping Policy and Refund Policy, govern the purchase and use of our products. By placing an order, you agree to these conditions.
1. ORDER ACCEPTANCE AND PRICING
1.1. Offer to Purchase: When placing an order, you are making an offer to purchase. Aegon Iron Work reserves the right to accept or decline any order for any reason at its discretion. 1.2. Acceptance: An order is not considered accepted until Aegon Iron Work confirms acceptance and processes payment. 1.3. Pricing and Discrepancies: The price charged will be the price in effect at the time the order is placed. Posted prices do not include taxes, shipping, handling, or customs charges, unless expressly stated otherwise.
2. SHIPPING, RISK OF LOSS, AND RESPONSIBILITY
2.1. Service and Costs: Free and quoted shipping rates apply only to the contiguous 48 U.S. states. The customer is responsible for all shipping charges and duties on international shipments. 2.2. Transfer of Risk (FOB Shipping Point): Title and the risk of loss for the product pass to the Purchaser at the moment Aegon Iron Work delivers the product to the shipping carrier. 2.3. In-Transit Damage and Loss: AEGON IRON WORK is not responsible for items that are lost or damaged once the product has been transferred to the carrier. Claims for lost or damaged items must be reported directly to the delivery carrier by the Purchaser to initiate an insurance claim. 2.4. Delays: We do not guarantee specific delivery dates. We are not responsible for delivery delays caused by the carrier.
3. LIMITED WARRANTY AND VOIDANCE
3.1. Sole Warranty: If an Aegon Iron Work product fails to function as warranted, the sole obligation of Aegon Iron Work under this warranty is the cost of repair or replacement of components that malfunction under normal use. 3.2. Voidance due to Installation and Use (Warranty Voidance): The Limited Warranty is NULL, VOID, AND OF NO EFFECT under the following conditions, considered a material breach of the terms of purchase and use: a. Non-Professional Installation: If the Product is not installed or maintained by a certified professional installer or technician who possesses the required licenses and insurance in the applicable jurisdiction. b. Failure to Follow Instructions: If the installation, alteration, maintenance, or use does not strictly follow the written instructions, manuals, and warnings provided by Aegon Iron Work. c. Misuse: If the Product is used for an unintended purpose or is subjected to abuse, negligence, accident, or unauthorized modification.
4. TOTAL ASSUMPTION OF RISK AND LIABILITY
4.1. Assumption of Risk: The Purchaser acknowledges and agrees that, from the moment of delivery, they assume the totality of the risk and responsibility for the safety and correctness of the installation, assembly, use, misuse, and maintenance of the Product. 4.2. Responsibility for Third-Party Installers: If the Purchaser hires or permits a third party to install the Product, the Purchaser shall be considered the sole party responsible for the selection, supervision, and instruction of said third party. Aegon Iron Work assumes no liability for the acts, errors, or negligence of third-party installers.
5. DISCLAIMER AND INDEMNIFICATION
5.1. LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PROVIDED BY LAW, AEGON IRON WORK SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM THE PRODUCT OR ITS FAILURE TO PERFORM, INCLUDING SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND (such as lost profits, loss of use, or personal injury). This limitation applies regardless of whether damages are sought under warranty, negligence, strict product liability, or contract. 5.2. Indemnification: The Purchaser agrees to indemnify, defend, and hold harmless Aegon Iron Work against any claim, demand, damage, or cost (including reasonable attorneys’ fees) arising out of (a) the Purchaser's breach of these Terms, (b) the access and use of the Product, or (c) the installation, handling, or service of the Product performed by any third party.
6. REFUNDS AND RETURNS
6.1. Return Policy: Returns are governed by our Refund Policy (30 days). The Purchaser is responsible for the return shipping costs. 6.2. Item Condition: To be eligible, the item must be unworn/unused and uninstalled, with tags, and in its original protective packaging. 6.3. Process: Returns must be initiated by contacting support@aegonironwork.com. Detailed instructions will be provided only after the return has been accepted. 6.4. Exclusions: We do not accept returns on sale items or gift cards.
7. GOVERNING LAW AND JURISDICTION
These Terms of Sale and any separate agreements shall be governed by and construed in accordance with the laws of the state of Florida, United States. You and Aegon Iron Work consent to venue and personal jurisdiction in the courts located in that state.
